1. Who we are

This website, thecornishhampers.co.uk, is operated by Cornish Hampers & Gifts ("we", "us", "our"), a family-run business based in Cornwall, United Kingdom. You can contact us at hello@cornishhampersandgifts.com.

2. These terms

These terms apply to every order placed through this website. By placing an order you agree to them. They do not affect your statutory rights as a consumer. If we change these terms, the version in force when you place your order applies to that order.

3. Orders and acceptance

Your order is an offer to buy. We accept it when we send you an order confirmation email, at which point a contract is formed. We may decline or cancel an order before dispatch — for example where a product is unavailable, a price or description was displayed in error, or we cannot deliver to your address — and if we do, we will refund you in full.

4. Prices and payment

All prices are in pounds sterling and include VAT where it applies. Delivery is free to mainland UK addresses. Payment is taken at checkout through our payment providers. If an obvious pricing error occurs, we are not obliged to supply goods at the incorrect price.

5. Delivery

  • Hampers containing fresh produce are dispatched Monday to Saturday. Order before 2pm for next-day delivery.
  • You choose your delivery date at checkout. Perishable items such as Cornish clotted cream are sent frozen via an overnight courier so they arrive chilled and ready to enjoy.
  • Because our products are perishable, someone should be available at the delivery address on the chosen day to refrigerate fresh items promptly. Please give us a mobile number and email address so the courier can send tracking and delivery options (safe place, neighbour).
  • If a parcel containing fresh or frozen produce is returned to the courier depot overnight — for example because nobody was available and no safe place was given — we cannot guarantee the quality of those products and cannot offer a refund or resend in that case.
  • Delivery dates are made in good faith but courier delays outside our control can occur. Where a perishable item arrives late and unfit to enjoy because of a courier failure, contact us and we will put it right.

6. Perishable goods and your right to cancel

Under the Consumer Contracts Regulations 2013, the usual 14-day right to cancel an online order does not apply to goods liable to deteriorate or expire rapidly — which covers our fresh hampers, pasties, cream teas and other perishable food. Once a perishable order has been dispatched it cannot be cancelled or returned.

You may cancel an order for perishable goods free of charge at any time before dispatch by emailing us. For non-perishable items (for example gift vouchers or non-food gifts, where sold separately), your normal 14-day cancellation right applies from the day after delivery.

7. Faulty, damaged or incorrect items

If anything arrives damaged, spoiled, incorrect or missing, contact us within 48 hours of delivery with your order number and photos where possible. We will resend, replace or refund as appropriate. Our full returns process is set out in our Refund policy, which forms part of these terms.

8. Product contents and substitutions

Hamper photographs are illustrative. Where an individual item within a hamper becomes unavailable, we may substitute it with an item of equal or greater value and similar character, so your hamper always arrives complete.

9. Allergens and dietary information

Ingredient and allergen information is shown on each product page, including per-option details where a product lets you choose contents. Our products are prepared in a kitchen that also handles gluten, dairy, eggs and nuts, so we cannot guarantee any item is free from traces of allergens. If you or the recipient has a food allergy, please review the product's allergen information before ordering and contact us if anything is unclear.

10. Gift vouchers

Gift vouchers are delivered by email, may be used across multiple orders until the balance is used, and cannot be exchanged for cash or resold.

11. Gift messages and personalisation

Free personalised gift messages are printed as you enter them, so please check spelling and recipient details carefully. We may decline to print content that is offensive or unlawful.

12. Website content and intellectual property

All content on this site — text, photography, logos and design — belongs to us or our licensors and may not be reproduced without permission. We take care to keep product descriptions accurate, but minor variations (for example packaging updates by our producers) can occur.

13. Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be limited. Otherwise, our liability to you in connection with any order is limited to the price paid for that order. We are not liable for delays or failures caused by events outside our reasonable control (including courier failures, extreme weather and supplier issues), though we will always try to put things right.

14. General

If any part of these terms is found unenforceable, the rest still applies. These terms are governed by the laws of England and Wales, and any dispute is subject to the non-exclusive jurisdiction of the courts of England and Wales. Nothing in these terms affects your statutory rights.

15. Complaints

If something goes wrong, email hello@cornishhampersandgifts.com and we will do our best to resolve it quickly. As a small family business, we would always rather fix a problem than lose a customer.
